Terms of use
This translation is provided for information only. Only the French version is legally binding; it applies in the event of any discrepancy. Read the French version
1. Purpose
These terms of use govern access to and use of the OSCAR application (web and mobile), published by Lou Ma Immobilier, by any account holder.
Outside France, OSCAR offers: account and profile, properties and rentals, importing your own leases and documents, a document vault, notes, deadlines and reminders that you enter yourself, document search and an assistant that answers from your own documents, holiday rental check-in reports with photos, anchoring of documents on the Bitcoin blockchain and their verification, and export of your data. Importing a document does not mean that OSCAR guarantees its compliance.
Services based on French law (generating leases, rent receipts, notices, regulated check-in reports, security deposits, rent reviews, tax, procedures…) are offered only for properties located in France; they are described in the French version of these terms.
Independent use of OSCAR (creating an account, accepting these terms, electronic signature) is reserved for adults and emancipated minors.
2. Pricing and subscription
First property managed free for 1 year (up to 30 documents), then €5/month per property, with no commitment.
Cancellation: at any time, free of charge and without giving reasons, from the Subscriptions section of the account. Cancellation takes effect at the end of the current billing period; paid features remain available until that date.
Refunds: unless mandatory legal provisions state otherwise, amounts already paid for a billing period that has started are not refunded pro rata if you cancel during the period.
Price changes: any price change is notified by email at least 30 days before it takes effect. Users who do not accept the new price may cancel their subscription before that date, without penalty.
3. Limits of the service and liability
OSCAR never provides certified legal, tax or accounting advice: the assistant's answers, reminders and other help offered are assistance tools, to be checked by the user or a professional before any decision or binding use.
Users remain solely responsible for the legal compliance of the documents they import, sign or send via OSCAR, and for the accuracy of the information they enter.
To the extent permitted by law, OSCAR's liability for the performance of these terms is limited to direct and proven damage, and capped at the total amount paid by the user in the 12 months preceding the event giving rise to the claim. This limitation does not apply in the event of gross negligence or wilful misconduct, nor to personal injury.
4. Electronic signature and blockchain anchoring
The electronic signature offered in OSCAR (for example on a holiday rental check-in report) is a simple electronic signature within the meaning of the eIDAS regulation, not a qualified signature. Documents can also be anchored on the Bitcoin blockchain (the most recognised and most secure in the world), which proves that they existed at a given date but does not raise the level of the signature itself. Full details, legal sources and eIDAS levels: Legal value of electronic signatures.
5. Closing and deleting the account
Users may ask for their account to be deleted at any time, without giving reasons: from the application (“Mes données” (My data) section, “Fermer mon compte” (Close my account) button), or by email to programneufs@gmail.com. Detailed procedure: Deleting your OSCAR account.
Identity check: to protect users against a mistake or fraudulent access to their account, a request made from the application requires their password (and their two-factor authentication code if they have enabled it). A request made by email is only processed after checking that it comes from the account holder.
30-day period: deletion is not immediate. It takes place 30 days after the request. An email is sent straight away to the account address, with a link to cancel the request; it can also be cancelled from the application throughout this period. During these 30 days no data is erased: users keep access to their account and can export their data and download their documents. It is up to them to do so before the end of the period.
At the end of the period: login credentials (email, password, two-factor authentication) are erased and logging in is no longer possible; personal identification data (name, telephone) is anonymised and the content of conversations with the Oscar assistant is erased. A confirmation email is sent.
Data kept: documents, payments and invoices are kept for the period required by law (10 years for accounting records and signed documents), in particular because they also concern other users (tenant, owner, guarantor). They are then no longer linked to information that directly identifies the deleted user, are only archived, and are deleted when these periods expire.
Subscription: deleting the account does not automatically cancel a current paid subscription. Users must cancel it from the Subscriptions section before their request; otherwise OSCAR cancels it when the account is deleted, without refunding the billing period already started (see article 2).
6. Governing law
These terms of use are governed by French law. In the event of a dispute, the parties will seek an amicable solution before any legal action.
Professional users (owner, managing agent, agency or business acting for the purposes of its professional activity): the Court of Tours (Tribunal de Tours), within whose jurisdiction Lou Ma Immobilier's registered office is located, has sole jurisdiction over any dispute relating to these terms.
Consumers (individuals acting for non-professional purposes, for example a tenant): the Court of Tours remains competent if the dispute is brought before it, but in accordance with mandatory consumer protection rules, consumers always keep the right to bring proceedings instead before the courts of their own domicile or of the place where the damage occurred.
